CONSTITUTION OF INDIA

No. RRS. 4690/98/ADM-5,-- In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all existing rules, orders or instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts of the Investigator, Class-III and Data Entry Operator, Class-III, in the Directorate of Economics and Statistics under the Planning Department of the Government of Maharashtra, namely :-

1. These rules may be called the Investigator, Class-III and Data Entry Operator, Class-III, in the Directorate of Economics and Statistics (Recruitment) Rules, 1991.

2. In these rules, unless the context requires otherwise,-

(a) “Directorate” means the Directorate of Economics and Statistics, Maharashtra State and its subordinate offices located at district places;

(b) “Government” means the Government of Maharashtra ;

(c) “Secondary School Certificate Examination” means the Secondary School Certificate Examination conducted by a Divisional Board under the Maharashtra Secondary and Higher Secondary Educational Board Act, 1965 (Mah. XLI of 1965) and includes any other examination declared by the Government to be equivalent thereto.

3. Appointment to the post of Investigator, Class-III in the Directorate shall be made either :-

(a) by promotion of a suitable person on the ‘basis of seniority subject to fitness from amongst the persons holding the posts of Fieldman or holding any other Class-IV post and who have passed Secondary School Certificate Examination and put in at least three year’s service in the post of Field man or in a particular post of Class-IV ; or

(b) by nomination from amongst candidates who, -

(i) unless already in the service of Government are not less than 18 years and not more than 28 years of age ; and

(ii) have passed the Secondary School Certificate Examination.

4. Appointment to the post of Data Entry Operator, Class-III in the Directorate shall be made either :-

(a) by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the posts of Fieldman or holding any other Class-IV posts and who have passed Secondary School Certificate Examination and put in at least three year’s service in the post of Fieldman or in a particular post of Class-IV and “have an effective speed of 10,000 key depression per hour on off line/ on line Data Entry Machine which shall be supported by a certificate from a recognised Data Entry Institute” or

(b) by nomination from amongst candidates who,--

(i) unless already in the service of Government are not less than 18 years and not more than 28 years of age ; and

(ii) have passed the Secondary School Certificate Examination ;

And

(iii) have an effective speed of 10,000 key depression per hour on off line/on line Data Entry Machine which shall be supported by a Certificate from a recognised Data Entry Institute.

5. Appointment by promotion and nomination to the post mentioned in rules 3 and 4 shall be made in the ratio of 25 : 75.

6. A person appointed to the posts mentioned in rules 3 and 4, whether by promotion or nomination shall be required to pass the examinations in Hindi and Marathi according to the rules made in that behalf, unless he has already passed or has been exempted from passing those examinations.

7. A person appointed to the posts mentioned in rules 3 and 4 shall be liable for transfer anywhere in the State of Maharashtra.
