CONSTITUTION OF INDIA.

No. RTR-1080/68 M/CR 5-85/XII. In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all existing rules, orders or instruments made in this behalf the Government of Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts in Class IV service mentioned in the Schedule appended hereto, in the Departments and Officers of the Government of Maharashtra, namely :-

1. These rules may be called the Maharashtra Claass IV posts in Government Departments and Offices (Recruitment) Rules 1986.

2. In these rules, unless the context requires otherwise –

(a) “appointing authority” in relation to any post specified in the Schedule, means an authority which is competent to make appointment to that post :

(b) “Department” means a Department specified in the First Schedule to the Maharashtra Government Rules of Buisness made under article 166 of the Constitution of India, and includes any office under the control of such Department.

(c) “Government” means the Government of Maharashtra:

(d) “Schedule” means the Schedule appended to these rules,

3. Appointment to the posts mentioned in Part-‘A’ of the Schedule shall be made by promotion of suitable persons, on the basis of seniority subject to fitness, from amongst the persons holding the posts mentioned in part ‘B’ of the Schedule and such of the persons holding the posts in part ‘C’ of the schedule who possess the educational qualifications prescribed under Sub-clause (ii) of clause (c) of rule 6.

4. Appointment to the posts mentioned in Part ‘B’ of the Schedule shall be made, either -

(a) by promotion of suitable persons on the basis of seniority subject to fitness form amongst the persons holding the posts mentioned in part ‘D’ of the Schedule or

(b) By transfer of suitable persons from amongst the persons holding the posts mentioned in Part ‘C’ of the Schedule and possessing the educational qualifications prescribed under sub-clause (ii) of clause (c) of rule 6.

5. Appointment to the posts mentioned in part – ‘C’ of the Schedule shall be made by promotion of suitable persons, on the basis of seniority subject to fitness, from amongst the persons holding the posts mentioned in part ‘E’ of the Schedule.

6. Appointment to the posts mentioned in Part –‘D’ of the Schedule shall be made, either –

(a) by promotion of suitable persons on the basis of seniority subject to fitness from amongst the persons holding the post mentioned in part ‘F’ of the Schedule, or

(b) by transfer of suitable persons from amongst the persons holding the posts mentioned in Part ‘E’ of the schedule and possessing the educational qualifications specified in sub-clause (c) or

(c) by nomination from amongst candidates, who –

(i) are not less than 18 years and not more than 28 years of age.

(ii) have passed the fourth standard primary school examination of a school recognised by Government,

Provided that, the appointing authority may relax the upper age limit upto 45 years in favour of candidates who are ex-servicemen and military pensioners.

7. Appointment to posts mentioned in Part ‘E’ of the Schedule shall be made by nomination form amongst persons who are not less than 18 years and not more than 28 years of age :

Provided that the appointing authority may relax upper age limit upto 45 years in favour of candidate who are ex-servicemen and military pensioners.

8. Appointments to post mentioned in Part- ‘F’ of the schedule shall be made by nomination from amongst person who –

(i) are not less than 15 years and not more than 18 years of age ; and

(ii) have passed the 4th standard primary school examination of a school recognized by Government.

9. Notwithstanding anything contained in the foregoing rules, recruitment to any of the posts mentioned in the Schedule may, in specila circumstances be made in such manner as the Government may deem necessary and direct from time to time, by issue of special or general orders in this behalf.
