Constitution of India-

No. Pavia-2679/51271-ADF-3. – In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in Supersession of all existing rules or orders issued in this behalf and in force in the State or any part thereof, the Governor of Maharashtra is herby pleased to make the following rules regulating the recruitment to the Class III ministerial posts of Superitendent, Senior Assistant, Senior Clerk, Senior Computor, Storekeeper and Survey Assistant in the Animal Husbandry Department of the Government of Maharashtra, namely :-

1. These rules may be called the ministerial posts of Superintendent, Senior Assistant, Senior Clerk, Senior Computor, Storekeeper and Survey Assistant in the Animal Husbandry Department (Recruitment) Rules, 1982.

2. In these rules, unless the context requires otherwise :-

(a) “Animal Husbandry Department” means the Animal Husbandry Department of the Government of Maharashtra ;

(b) “Degree” means a degree of a statutory University ;

(c) “Government” means the Government of Maharashtra ;

(d) “Secondary School Certificate Examination” means the Secondary School Certificate Examination conducted by a Divisional Board under the Maharashtra Secondary Education Board Act, 1965 (Maharashtra XLI of 1965) and includes any other examination declared by Government as equivalent thereto.

3. Appointment to the post of Superintendent in the Animal Husbandry Department shall be made by promotion of a suitable person on the basis of seniority subject to fitness from amongst person holding the post of Senior Assistant in the Animal Husbandry Department.

4. Appointment to the post of Senior Assistant in the Animal Husbandry Department shall be made either :-

(a) by promotion of a suitable person on the basis of seniority subject to fitness from among persons holding the post of Senior Clerk in the Animal Husbandry Department ; or

(b) by nomination from amongst candidates, who, -

(i) unless already in the service of Government, are not more than 28 years of age ; and

(ii) possess a degree of a statutory University.

5. Appointment to the posts of Senior Clerk, Senior Computor and Storekeeper in the Animal Husbandry Department shall be made, either, -

(a) by promotion of a suitable person on the basis of seniority subject to fitness from amongst persons holding the post of Junior Clerk or Survey Assistant in the Animal Husbandry Department ; or

(b) nomination from amongst candidates, who, -

(i) unless already in the service of Government, are not more than 28 years of age ; and

(ii) possess a degree of a statutory University.

6. Appointment to the post of Survey Assistant in the Animal Husbandry Department shall be made by nomination from amongst candidates, who, -

(a) Unless already in the service of Government, are not more than 28 years of age ; and

(b) have passed the Secondary School Certificate Examination with the Subject English and Mathematics and have rural aptitude.

7. Appointment to any of the posts mentioned in rules 4 and 5 by promotion and nomination shall be made in the ratio of 75 : 25.

8. A person appointed to any of the posts mentioned in rules 3, 4 and 5 whether by promotion and nomination or by nomination, shall be required to pass the Departmental examination and a person appointed to any of the posts mentioned in rules 3, 4, 5 and 6 shall be required to pass an examinations in Hindi and Marathi according to the rules made in that behalf, unless he has already passed or has been exempted from passing these examinations.

9. A person appointed to any of the post mentioned in rules 3, 4. 5 and 6 shall be liable for transfer anywhere in the State of Maharashtra.
