No. PAVIA. 2679/18502-(CR-149)/2-ADF. – In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in suppression of all existing rules. Orders or instruments made in this behalf, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the post of Director of Animal Husbandry, Maharashtra Animal Husbandry Service Class I supertime scale and to the post of Joint Director of Animal Husbandry, in the Diretorate of Animal Husbandry, Agriculture and Co-operation Department of the Government of Maharashtra, namely :-

1. These rules may be called the Director of Animal Husbandry and Joint Director of Animal Husbandry ( Directorate of Animal Husbandry, Agriculture and Co-operation Department), Recruitment Rules, 1982.

2. Appointment to the post of Director of Animal Husnandry in the Directorate of Animal Husbandry, Agriculture and Co-operation Department, shall be made either-

(a) by promotion of a suitable person on the basis of positive merit from amongst the persons holding the post of Joint Director of Animal Husbandry in the cadre of Maharashtra Animal Husbandry in Class-I.

or

(b) by appoint of a member of the I.A.S. cadre.

3. Appointment to the post of Joint Director of Animal Husbandry in the Directorate of Animal Husbandry, Agriculture and Co-operation Department shall be made either-

(a) by promotion of a suitable person on the basis of positive merit from amongst the persons holding the posts of Deputy Director of Animal Husbandry or equivalent posts in the grade Rs. 1,000-1,500 in the cadre of Maharashtra Animal Husbandry Service, Class I.

or

(b) by transfer of a suitable officer from the cadre of Mahrashtra State Civil Service Senior Class I.

4. The person appointed to the post by promotion shall be required to pass the Departmental Examination in Accounts and examinations in Hindi and Marathi according to the rules made in that behalf unless he has already passed, or has been exempted from passing these examination.

No. PAVIA. 2685/2689/CR-213/ADF-1. – In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Maharashtra is hereby pleased to make the following rules to amend the Director of Animal Husbandry and Joint Director of Animal Husbandry (Directorate of Animal Husbandry, Agriculture and Co-operation Department) Recruitment Rules, 1982, namely:-

 

1. These rules may be called the Director of Animal Husbandry and Joint Director of Animal Husbandry (Directorate of Animal Husbandry, Agriculture and Co-operation Department) Recruitment (Amendment) Rules, 1989.

2. In the preamble of the Director of Animal Husbandry and Joint Director of Director of Animal Husbandry (Directorate of Animal Husbandry, Agriculture and Co-operation Department) Recruitment Rules, 1982 (herein after referred to as “the principal rules”),-

  1. for the words “post of Director of Animal Husbandry” the words posts of “Director of Animal Husbandry and Additional Director of Animal Husbandry” shall be substituted:

  2. for the words “Agriculture and Co-operation Department” the words “Agriculture, Animal Husbandry, Dairy Development and Fisheries Department”

3. For rule 1 of the principal rules, the following shall be substituted, namely:-

“1. These rules may be called the Director of Animal Husbandry, Additional Director of Animal Husbandry and Joint Director of Animal Husbandry” (Directorate of Animal Husbandry, Agriculture, Animal Husbandry, Dairy Development and Fisheries Department) (Recruitment) Rules, 1982”

4. In rule 2 of the principal rules:-

(a) in the opening portion, for the words, “post of Director of Animal Husbandry in the Directorate of Animal Husbandry, Agriculture and Co-operation Department” the following shall be substituted, namely:-

“post of Director of Animal Husbandry and Additional Director of Animal Husbandry, in the Directorate of Animal Husbandry, Agriculture, Animal Husbandry, Dairy Development and Fisheries Department”;

(b) in clause (a), for the words and figure “in Class-I” the words, figure and brackets “Service Class-I (Senior)” shall be substituted.

5. In rule-3 of the principal rules:-

(a) in the opening portion, for the words “Agriculture and Co-operation Department” the words, “Agriculture, Animal Husbandry, Dairy Development and Fisheries Department” shall be substituted’

(b) in clause (a) for the words and figures “in the grade of Rs. 1,000—1,500 in the cadre of Maharashtra Animal Husbandry Service Class-I.” the words, figure and brackets. “in the cadre of Maharashtra Animal Husbandry Service Class-I (Senior) .” shall be substituted.

No. Paasmpra. 1995/25771/CR-63/ADF-1.- In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India, and in supersession of all existing rules, orders or instruments made in this behalf, the Governor of Maharashtra is hereby pleased pleased to make the following rules regulating recruitment to the post of Additional Director of Animal Husbandry Joint Director of Animal Husbandry, Deputy Director of Animal Husbandry, Deputy Director of Animal Husbandry and Assistant Director of Animal Husbandry, Maharashtra Animal Husbandry Services, Group A, in the Animal Husbandry Department under the Agriculture, Animal Husbandry, Dairy Development And Fisheries Department of Government of Maharashtra, namely:-

1. The rules may be called the Additional Director, Joint Director, Deputy Director and Assistant Director in the Maharashtra Animal Husbandry Services, Group-A, in the Animal Husbandry Department (Recruitment) Rules, 1997.

2. In these rules unless the context otherwise requires,-

(a) “Animal Husbandry Department” means the Animal Husbandry Department under the Agriculture, Animal Husbandry, Dairy Development and Fisheries Department of Government’

(b) “Commission” means Maharashtra Public Service Commission;

(c) “Degree” means a degree of a statutory University:

(d) “Government” means the Government of Maharashtra.

3. Appointment to the post of Additional Director of Animal Husbandry, Maharashtra Animal Husbandry Services, Group-A, in the Animal Husbandry Department, shall be made by promotion on the basis of strict selection from amongst the persons holding the post of Joint Director of Animal Husbandry, having a degree in Veterinary Science and having not less than years regular service in the post of Assistant Director of Animal Husbandry, Deputy Director of Animal Husbandry and Joint Director of Animal Husbandry collectively.

4. Appointment to the post of Joint Director of Animal Husbandry, Maharashtra Animal Husbandry Department, shall be made by promotion on the basis of strict selection from amongst of the persons holding the posts of Deputy Director of Animal Husbandry:

Provide that, the number of posts of Joint Director of Animal Husbandry being filled from the cadre of Deputy Director of Animal Husbandry Veterinary Science and Fodder Development, respectively will be decided by Government on the basis of the existing number of sanctioned posts of Deputy Directors of both these streams, to ensure equitable chances of promotions to both. However, there will be at least one post of Joint Director from the fodder stream.

5. Appointment to the posts of Deputy Director of Animal Husbandry, Maharashtra Animal Husbandry Services, Group-A, in the Animal Husbandry Department, shall be made by promotion on the basis of strict selection from amongst the persons holding the posts of Assistant Director, Animal Husbandry in Maharashtra Animal Husbandry Services, Group-A, for not less than three years in regular service in the past; and possessing a degree of B.V.Sc or Animal Husbandry and registered as the registered Veterinary Practitioner under the Veterinary Practitioners Act, Prevailing at the time.

6. Appointment to the post of Assistant Director of Animal Husbandry, Maharashtra Animal Husbandry Services, Group-A, in the Animal Husbandry Department shall be made either,-----

(a) by promotion of a suitable person on the basis of seniority, subject to fitness from amongst the persons holding the post of Live-Stock Development Officer, having not less than three years regular service in that post and possessing an inservice Diploma in B.V.Sc. or Animal Husbandry; or

(b) by nomination from amongst the candidates who—

(i) unless already in the service of Government are not more than 35 years of age; and

(ii) possess Master’s Degree in Veterinary Science;

(iii) possess practical experience in Animal Husbandry for a period of not less than 5 years gained after acquiring the qualification mentioned in sub-clause (b) (ii) above in a Government Department or in an Industrial Undertaking or Commercial Concern or Local Authority or Board established by Government:

Provided that, the age-limit may be relaxed by Government, on the recommendation of the Commission in favour of candidates having exceptional qualifications or experience or both.

(c) Notwithstanding anything contained in sub-clause (iii) of clause (b) of this Rule, if at any stage of the selection for the post of Assistant Director of Animal Husbandry, Group-A, the Commission is of the opinion that sufficient number of candidates possessing prescribed experience of 5 years are not available to fill-up the vacancies reserved for candidate belonging to the Scheduled Castes and Scheduled Castes converts to Buddhism Scheduled Tribes, Denotified Tribes or Nomadic Tribes than, the Commission may, in the matter of such selection, relax the period of experience to the extent of 40 per cent.

7. Appointment to the total posts including Temporary and Permanent Posts in the cadre of Assistant Director of Animal Husbandry by promotion and Nomination shall be made in the ratio of 50 : 50.

8. A person appointed to the post mentioned in Rule 6, by nomination shall be on promotion for a period of two years.

9. A person appointed to the post mentioned in Rules 3, 4, 5 and 6, whether by promotion or nomination, shall be required to pass the Departmental Examinations in (i) Accounts (ii) Hindi and (iii) Marathi according to the Rules made in that behalf, unless he has already passed; or has been exempted from passing these examinations.

10. A person appointed to the posts mentioned in Rules 3, 4, 5 and 6, shall be liable for transfer anywhere in the State of Maharashtra.

11. A person selected for appointment to the post mentioned in Rule shall be required to get himself registered under the Maharashtra Veterinary Practitioners Act, 1971, or under any other Act prevailing at the time of appointment before joining the post, unless he has so registered himself.
