CONSTITUTION OF INDIA

No. Pavia. 2680/7484(298)/ADF-5. – In exercise of the powers conferred by the proviso to article 309 of the Constitution of India and in supersession of all existing rules, orders or instruments made in this behalf, and in force in the State or any part thereof, the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts of Fodder Development Officer in Maharashtra Animal Husbandry Service Class II in the Animal Husbandry Department of the Government of Maharashtra, namely :-

1. These rules may be called the Fodder Development Officer in the Animal Husbandry Department (Recruitment) Rules, 1984.

2. In these rules unless the context requires otherwise, --

(a) “Animal Husbandry Department” means the Animal Husbandry Department of the Government of Maharashtra;

(b) “Commission” means the Maharashtra Public Service Commission;

(c) “Government” means the Government of Maharashtra

3. Appointment to the post of Fodder Development Officer in the Animal Husbandry Department shall be made either,--

(a) by promotion of a suitable person on the basis of seniority subject to fitness from amongst the persons holding the post of Assistant Fodder Development Officer, Agriculture Officer, or Technical Assistant to Fodder Development Officer in the Animal Husbandry Department, having not less than 3 years service in Class III service in that Department ; or

(b) by nomination from amongst candidates who, --

(i) unless already in the service of Government are not more than 30 years of age;

(ii) possess experience in fodder development activities for not less than 3 years after acquiring qualification mentioned at (ii) above ;

Provided that the age limit may be relaxed by Government on the recommendation of the Commission in favour of candidates having exceptional qualification or experience or both.

4. Notwithstanding anything contained in sub-clause (iii) of clause (b) of rule 3, if at any stage of selection the Commission is of the opinion that sufficient number of candidates possessing the requisite experience are not available to fill the vacancies reserved for candidates belonging to the Schedule Cases, Scheduled Castes converts to Buddhism, Scheduled Tribes, Denofied Tribes or Nomadic Tribes, then the Commission may in the matter of such selection, relax the requirement in respect of the period of experience therein and select suitable candidates belonging to such Castes or Tribes.

5. Appointment to the post by promotion and nomination shall be made in the ratio of 50 : 50.

6. A person appointed to the post by nomination shall be on probation for a period of two years.

7. A person appointed to the post, whether by promotion or nomination, shall be required to pass the Departmental Examination and examinations in Hindi and Marathi according to the rules made in that behalf, unless he has already passed or has been exempted from passing those examinations.

8. A person appointed to the post shall be liable for transfer anywhere in the State of Maharashtra.

No. PAVIA. 2681/4847/(185)ADF-2.—In exercise of the powers conferred by the proviso to article 309 of the Constitution of India, the Governor of Mahrashtra is hereby pleased to make the following rules further to amend the General State Service, Class II (Animal Husbandry Department) (Recruitment) Rules, 1979, namely :-

1. These rules may be called the General State Service, Class II (Animal Husbandry Department) (Recruitment) (Amendment) Rules, 1982.

2. In rule 2 of the General State Service Class II (Animal Husbandry Department) (Recruitment) Rules, 1979, for the words “five years service in that post” the words “three years service in Class III” shall be substituted.

No. Pavia. 2678/6313/3-ADF – In exercise of the powers conferred by the proviso to article 309 of the constitution of India and in supersession of all existing rules, orders or instruments made in this behalf the Governor of Maharashtra is hereby pleased to make the following rules regulating recruitment to the posts in General State Service, Class-II, in the Animal Husbandry Department of the Government of Maharashtra namely :-

1. These rules may be called the General State Service, class-II (Animal Husbandry Department) (Recruitment) Rules, 1979.

2. Appointment to a post in General State Service, Cl. II, in the Animal Husbandry Department shall be made by promotion of a suitable person from amongst the persons holding the posts of Superintendents in the Ministerial Cadre in the Animal Husbandry Department having not less than five years service in that post.

3. A person appointed to the post shall be required to pass the Departmental examination in accounts and examinations in Hindi and Marathi according to the rules made in that behalf, unless he has already passed, or has been exempted from passing, those examinations.
